1. Scope

This Messaging and Anti-Spam Policy applies when Customer uses Demand Trail to send, schedule, automate, relay, route, or manage email and any future SMS, calling, or similar communication functionality.

This Policy is designed to permit legitimate business communications, including lawful business-to-business outreach where applicable law permits it, while protecting recipients, sending infrastructure, and platform reputation.

2. Customer Is Responsible for Sending

Customer is responsible for its campaigns and messages and is the sender or initiator to the extent provided by applicable law. Demand Trail provides technology that acts on Customer instructions.

Customer is responsible for audience selection, list provenance, sender identity, message content, required disclosures, legal basis, consent where required, opt-out handling, suppression, frequency, and compliance with applicable marketing and privacy laws.

3. Lawful Basis and List Provenance

Customer may message only recipients for whom Customer has a lawful basis under applicable law. Depending on jurisdiction and message type, that basis may require consent or may permit another basis for legitimate business-to-business communications.

Customer must be able to demonstrate where recipient data came from and that Customer has a lawful right to use it for the intended communication. Data may not be obtained through unlawful harvesting, credential theft, unauthorized access, or sources whose terms prohibit the intended use.

Use of purchased, licensed, enriched, or third-party business data does not by itself establish legal permission to message a person. Customer remains responsible for evaluating the source, license, jurisdiction, purpose, notices, and applicable law.

4. Sender Identity and Message Content

Messages must use accurate and non-deceptive sender information, domains, display names, headers, routing information, and subject lines.

Customer must not impersonate another business or individual, conceal the commercial nature of a message where disclosure is legally required, or use misleading claims designed to obtain engagement through deception.

Customer must include a valid business identity and physical postal address where required by applicable law.

5. Opt-Outs and Suppression

Marketing and outreach messages must include a clear opt-out mechanism where required by law or Demand Trail policy.

Customer must honor valid opt-out requests promptly and must not intentionally re-add a suppressed recipient to the same category of communication without a new lawful basis that permits re-subscription.

Demand Trail may provide account-level or platform-level suppression functionality. Customer may not bypass suppression controls to continue prohibited sending.

6. Technical Sending Standards

Customer must maintain appropriate sender authentication and DNS configuration for domains used through the Services, including SPF, DKIM, DMARC, or other standards required by Demand Trail or the applicable provider.

Customer must follow reasonable sending limits, warm-up requirements, rate limits, bounce controls, complaint controls, and reputation safeguards communicated in Documentation or product notices.

Demand Trail may reject, throttle, or pause sending when bounce rates, complaint rates, blocklisting, authentication failures, provider restrictions, abnormal volume, or other signals create material deliverability or abuse risk.

7. Transactional and Operational Messages

Transactional, security, account, and operational messages may be subject to different legal requirements than marketing messages. Customer is responsible for classifying its messages correctly and must not label promotional content as transactional to avoid compliance obligations.

8. Sending Infrastructure and Third-Party Providers

Demand Trail may deliver communications using its own infrastructure, infrastructure provisioned through third-party providers, or Connected Services selected by Customer. Third-party provider rules, technical restrictions, and acceptable use requirements may apply in addition to this Policy.

A provider may reject, defer, filter, rate-limit, or suspend messages or sender identities. Demand Trail is not responsible for provider actions outside its reasonable control.

9. No Deliverability Guarantee

Demand Trail does not guarantee delivery, inbox placement, spam-folder placement, open rates, reply rates, or campaign performance. Deliverability depends on many factors outside Demand Trail's control, including sender reputation, domain history, recipient behavior, content, DNS, provider filtering, and third-party systems.

10. Inbound Email and Mailbox Hosting

Unless an Order expressly states otherwise, Demand Trail is not a general-purpose mailbox provider and does not replace a business email hosting service. Any inbound message synchronization, reply capture, unified inbox, or similar functionality is limited to the features described in the applicable Documentation.

11. Enforcement and Suspension

Demand Trail may investigate complaints, abuse reports, unusual sending patterns, authentication failures, blocklisting, or provider notices. Demand Trail may require evidence of list provenance or lawful sending practices.

Demand Trail may restrict or suspend sending without advance notice where reasonably necessary to protect recipients, infrastructure, provider relationships, or other customers. Repeated or serious violations may result in termination.
